Drinks by Nika Terms and Conditions of Service

 

Please read these Terms of Service ("Terms") carefully before using our mobile bartending services. These Terms constitute a legal agreement between you ("User", "you", or “client”) and Drinks by Nika ("Company," "we," or "us"). By using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If the items in these terms and conditions are not met, we reserve the right to either withdraw our services or make an additional charge to cover our reasonable costs and /or losses in revenue.

 

Legal Drinking Age Requirement in Ontario:

By using our mobile bartending services, you confirm that you are of legal drinking age in the Province of Ontario, Canada. The legal drinking age in Ontario is 19+. We strictly adhere to the legal drinking age requirements, and we reserve the right to request identification to verify your age before serving any alcoholic beverages. If you fail to provide valid identification or are found to be underage, we will not be able to provide our bartending services to you. 

 

Please note: We reserve the right to not over serve alcohol to guests, customers or patrons. Excessive drinking, abusive or threatening language or action to staff, customers, or guests will not be tolerated.

 

Scope of Services:

Our mobile bartending services include the provision of professional bartenders, bar setup, and bartending equipment for events, parties, classes, or gatherings. We strive to provide exceptional bartending services, ensuring that all alcoholic beverages are served responsibly and in compliance with applicable laws and regulations.

 

Booking and Payment:

To book our mobile bartending services, you must provide accurate information about your event, including the date, time, location, expected number of attendees, and any specific requirements. We reserve the right to decline or cancel a booking based on our availability or other considerations.

 

Payment for our services is required as per the agreed terms. We accept electronic payments, such as credit/debit cards or electronic fund transfers (e-transfers), through secure payment gateway - Wave Invoicing. 

 

You are required to pay a non-refundable deposit of $100 to secure services, which shall be credited towards the total cost of the services. The $100 non-refundable deposit is due upon receipt of invoice. The remaining balance is due by the event start time.

 

By making a payment, you authorize us to charge the specified amount for the requested services. All payments are non-refundable unless otherwise agreed upon. 

 

Cancellation and Refunds:

If you need to cancel or reschedule your booking, please notify us in writing at least 48 hours prior to the event. In the event of a cancellation 48 hours prior to the event, the deposit paid can go towards a future booking. In the event of a cancellation within 48 hours of the scheduled event, you forfeit the deposit paid to secure the services. Paid deposits for services and payments for services are non-refundable. 

 

Access to Venue for Event:

Client shall ensure sufficient time is available to access venue prior to the commencement of the event for unloading and preparation.

 

Client shall also provide efficient time from closing of the bar to vacate venue allowing products and equipment to be dismantled, removed and loaded out.

 

Vehicle Parking:

Secure parking shall be available next to or near venue access point to facilitate seamless loading and unloading to venue.

 

Liability:

While we take every precaution to provide safe and responsible bartending services, we shall not be held liable for any damages, injuries, losses, or claims arising from the consumption of alcoholic beverages or any other activities associated with our services. We recommend that you and your guests drink responsibly and do not operate any motor vehicles under the influence of alcohol.

 

Indemnification:

You agree to indemnify and hold harmless the Company, its employees, contractors, and agents, from and against any claims, liabilities, damages, losses, costs, or expenses arising out of or related to your use of our mobile bartending services or any breach of these Terms.

 

Modification of Terms:

We reserve the right to modify these Terms at any time, without prior notice. Any changes will be effective immediately upon posting on our website or notifying you via email or other means of communication. By continuing to use our services after any modifications, you acknowledge and accept the updated Terms.

 

Governing Law and Jurisdiction:

These Terms shall be governed by and construed in accordance with the laws of the province of Ontario, Canada. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario.

 

Severability:

If any provision of these Terms is deemed invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

 

Privacy:

We are committed to protecting your privacy and ensuring the security of your personal information. This Privacy Clause explains how we collect, use, and disclose your personal data when you use our mobile bartending services.

 

a. Collection and Use of Personal Information:

We may collect certain personal information from you, including but not limited to your name, contact details, event details, and payment information. We collect this information for the purpose of providing our bartending services and managing your bookings. We may also use your contact information to communicate with you regarding your event or to provide updates on our services.

 

b. Data Sharing and Disclosure:

We may share your personal information with third-party service providers who assist us in delivering our bartending services. These service providers are contractually obligated to protect the confidentiality and security of your personal information and are not permitted to use it for any other purposes.

 

We may also disclose your personal information if required by law or if we believe that such disclosure is necessary to protect our rights or comply with a judicial proceeding, court order, or legal process.

 

c. Data Security:

We implement reasonable security measures to protect your personal information from unauthorized access, use, or disclosure. However, please be aware that no method of transmission over the internet or electronic storage is 100% secure. While we strive to protect your personal information, we cannot guarantee its absolute security.

d. Retention of Personal Information:

We will retain your personal information for as long as necessary to fulfill the purposes outlined in these Terms, unless a longer retention period is required or permitted by law.

 

e. Your Rights:

You have the right to access, correct, or delete the personal information we hold about you. If you would like to exercise any of these rights, please contact us using the contact information provided below.

 

f. Third-Party Links:

Our website or communications may contain links to third-party websites or services. We are not responsible for the privacy practices or the content of such third-party websites. We encourage you to review the privacy policies of those third parties before providing any personal information.

 

g. Changes to the Privacy Clause:

We reserve the right to update or modify this Privacy Clause at any time, without prior notice. Any changes will be effective immediately upon posting on our website or notifying you via email or other means of communication. By continuing to use our services after any modifications, you acknowledge and accept the updated Privacy Clause.
